ABA Family Law Quarterly – Editorial Staff

The Family Law Quarterly (FLQ) is the American Bar Association Family Law Section’s scholarly journal. It is dedicated to publishing articles written by legal academics and practitioners about important and timely legal issues for family law practitioners, judges, professors, and more.

In this co-curricular course, ˿APP students are responsible for editing and source-checking each article that is selected for publication in the FLQ. They are also responsible for researching and updating charts of state family law-related statutes, and preparing digests of important decisions and/or family law-related legal scholarship. This course will help students hone their skills in editing, grammar, research, drafting, and citation. It will also help them develop leadership skills. In the first year of the course, all students will attend a seminar that will review relevant family law concepts, legal research, editing, citation, and other skills related to FLQ participation.

Recommended for the Following Professional Pathways: Family Law, Government and Public Sector, and General Practice.

1 credit per semester for members. 2 credits per semester for E-Board members. Full-year course

Administrative Law

The complexity of modern government means that much governing is done not by the traditional three branches but by administrative agencies with quasi-legislative and quasi-judicial, as well as executive, functions. This course explores administrative process and procedure: how, in the federal government, the Constitution, Congress (through organic statutes and the Administrative Procedure Act), the courts, and the agencies themselves help define the powers and responsibilities of the independent and executive agencies. The course examines specific agencies as bureaucratic institutions, considers approaches to regulatory reform, and specially emphasizes the courts.

This is a substantive course that deals with law and policy.

Advanced Appellate Advocacy

This course will cover the basic procedural and substantive issues involved in the filing, preparation, and arguing of an appeal, including the requirement of preservation and the applicable standard of review.

Working with a case file, students will have the opportunity to prepare an appellate brief and engage in oral arguments, thereby developing advanced skills in both written and oral advocacy. Students will have opportunities to become involved in actual appeals by observing practicing appellate arguments and participating in moots to help prepare appellate attorneys for oral arguments.

Approved for the Experiential Learning Requirement and satisfies the Writing Requirement.

Please note: Per ABA rules, this course may only be used for one graduation requirement. Students must communicate with the Registrar to elect to count the course for either Writing Requirement or Experiential Learning Requirement.

Advanced Corporate Tax

This course examines the tax consequences of various forms of taxable as well as nontaxable mergers and acquisitions. Building upon the distribution and liquidation regime covered in TAX 110, it considers the Section 338 election in the context of practical merger and acquisition planning. Tax-free reorganizations are examined in some detail, including the tax consequences to the parties and circumstances in which one or another type of reorganization may be appropriate. The course will introduce students to intragroup sales subject to Section 304 and the closely related.

This course complements and goes beyond TAX 110 Federal Income Tax: Corporate. A substantive/statutory course that deals with law, theory, and policy in the context of the U.S. Tax Code.

Open to Tax LL.M. students.

Advanced Legal Methods

This course consolidates the predictive analysis and professional writing skills that first-year students have been developing. The class offers multiple opportunities for writing practice and feedback, while helping to create bridges between students’ understanding of academic exam-driven analysis and writing and context-driven professional writing. The course centers on writing exercises drawn from a series of case files that address core legal topics drawn from first-year subjects. It reinforces substantive knowledge of selected key legal rules while applying those rules in a variety of different legal genres.

A foundational skills course in which students synthesize their learning. The course practices an array of forms of professional writing and analysis. It applies analytical competencies that will be important for the Uniform Bar Examination (UBE), with a special emphasis on the skills required in the Multistate Performance Test (MPT) and the Multistate Essay Examination (MEE), as well as reinforcing skills needed for the practice of law.

Core Curriculum Course: Full-time Day Division students complete this course during their 1L spring term. Evening Division students complete this course during their 2LE fall term.

This course builds on principles from Real Estate Transactions and Finance. It examines legal issues related to the initial development of real estate from the ground up and complex issues related to the financing, ownership, and operation of commercial properties. Topics may include: commercial mortgage commitments; permanent financing; construction lending and mechanics’ liens; subordinated financing; lender liability related to construction; ground lease financing; commercial leases; shopping center development and operation; condominium and cooperative development and operation; distressed properties; the effect of environmental regulation on real estate transactions; green leases and sustainable development; and globalization of American real estate transactions.

This upper-level course focuses on the legal and business issues of sophisticated real estate transactions, i.e., transactions beyond the sale of an existing residence or an existing, basic commercial property. It represents a final step for students in the area of real estate transactions and finance. The course provides substantive learning through cases, statutes, and scholarly and professional articles. It also develops skills by having the students address, critique, and alter sample transaction documents in light of lessons learned and through the use of problems. The course focuses on developing a transactional approach to issues, applicable to real estate, corporate, business, and other related practices.

Advanced Topics in Dispute Resolution

This seminar course offers the opportunity for intense and robust investigation of discrete issues arising in the course of resolving disputes by means other than the courts. Students will prepare and discuss issues of public policy, practice, and theory, and they will be responsible for original scholarship on a topic of their choosing. Issues may include cross-cultural negotiation, investor-state conciliation, public policy of mediation confidentiality, consequences of diversity in arbitration, mediation practices outside the United States, and conflict resolution in religious communities.

The course is the post-introductory offering in Alternative Dispute Resolution (ADR). It will require students to become conversant with current issues of policy regarding court-annexed and independent dispute resolution processes with an emphasis on such topics as implicit bias in “neutral” arbitrators and mediators; the increasing concern of lack of diversity among ADR practitioners; the impact of globalization on traditionally culturally homogeneous approaches to ADR; and broad public policy questions such as class action waiver and confidentiality of mediation communications.
